MK Fintech Partners Ltd: Malta VFA Licensing Clarifications

MK Fintech Partners Ltd – public statements amendments to recent post…
When strong international branding meets local ambiguity: Malta’s regulatory landscape faces renewed scrutiny.
Michael Kyprianou Law Firmis a well-established international law firm, with more than 60 lawyers and offices across 11 jurisdictions. Its Malta office, based in Birkirkara, is active in a range of areas including blockchain advisory, corporate services and virtual financial assets.
Despite the firm’s high-profile presence and expertise, certain matters concerning its operations in Malta remain unclear.
Dr.Justine Scerri Herrera and Matteo Alessandro are among the most prominent legal professionals associated with the firm locally, advising on matters regulated under Maltese and European frameworks. Malta Media contacted them with specific questions regarding Damex Digital LTD and their connections to them in view of licensing responsibilities, VFA agent appointments and data handling policies in connection with a particular client.
Rather than receiving detailed clarifications, we were met with legal correspondence challenging our enquiries. This correspondence included warnings that we consider to be disproportionate and may be interpreted by some as an attempt to dissuade legitimate journalistic inquiry.
Further questions were also raised concerning MK Fintech involvement with Damex Digital LTD. Damex Digital LTD is a company registered at the same business address as MICHAEL KYPRIANOU SERVICES LTD. one of the directors of Damex Digital LTD is Dr. Justine Scerri Herrera ad also publicly listing shows that Michael Kyprianou Services Ltd is appointed as a company secretary.
Public registry records and online materials have indicated that MK Fintech Partners Ltd may be engaged in the provision of corporate and financial services, including in areas connected to virtual financial assets.
In correspondence received from individuals associated with the firm, it was stated that MK Fintech does not and has never provided the client in question with any services. This included denials of having acted as a VFA Agent, registered office provider or in any related support capacity.
Following further clarification from Dr. Justine Scerri Herrera, it is understood that MK Fintech previously held authorisation as a Virtual Financial Assets (VFA) Agent in Malta until August 2024. At that time, the VFA Agent role was removed from Maltese legislation and all former licence holders, including MK Fintech, surrendered their authorisations.
Looking at the social media page of MK Fintech Partners Ltd as of 08.08.2025, they still clearly indicate that they are: “MK Fintech Partners Ltd is a Maltese licensed VFA Agent focusing on fintech, crypto and investments.“ the link can be easily accessed here: https://www.facebook.com/MKFintechPartnersLtd/
According to Dr. Scerri Herrera, the VFA Agent designation was historically required for crypto-asset service providers seeking licensing with the Malta Financial Services Authority.
Dr. Scerri Herrera has further stated that MK Fintech has never held a trustee or Company Service Provider (CSP) licence, has never provided trustee or registered address services to clients and that representing or advising crypto businesses for licensing purposes is no longer a licensable activity in Malta following the legislative changes.
In regards to the registered office, we are surprised to see listings of the MK Fintech Partners Ltd like on Chambers, being at the same address as Damex Digital Ltd and MICHAEL KYPRIANOU SERVICES LTD. So we have to assume that they all just share an office.
